DMCA Copyright Policy

Zophous.ai respects intellectual property rights and expects all users of our Services to do the same. This policy describes how to report copyright infringement and how Zophous.ai handles such reports under the Digital Millennium Copyright Act (17 U.S.C. § 512).

1. Designated DMCA Agent

We have designated an agent to receive notifications of claimed copyright infringement:

An official Copyright Office registration is on file. This contact is for copyright matters only. Notices submitted without the required subject line may not be processed promptly.

2. How to File a Takedown Notice

To submit a valid DMCA takedown notice under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are at issue).
  2. Identification of the infringing material with sufficient detail for us to locate it — for example, the clip URL, job ID, or account username.
  3. Your contact information: full legal name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or applicable law.
  5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
  6. Your physical or electronic signature.

Incomplete notices will not be processed. Knowingly submitting a false or misleading takedown notice may expose you to liability under 17 U.S.C. § 512(f), including damages, attorneys' fees, and costs.

3. What Happens After We Receive a Notice

Upon receiving a valid takedown notice, Zophous.ai will:

  • Promptly remove or disable access to the allegedly infringing material.
  • Notify the account holder whose content was removed.
  • Provide the account holder an opportunity to file a counter-notice (see Section 4 below).

We may forward the full contents of your takedown notice — including your contact information — to the affected account holder.

4. Counter-Notice Process

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g). A valid counter-notice must include:

  1. Identification of the removed material and where it appeared on our platform before removal.
  2. A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
  3. Your full legal name, mailing address, telephone number, and email address.
  4. A statement consenting to jurisdiction of the Federal District Court for the district in which you reside (or any US judicial district if you reside outside the US), and that you will accept service of process from the original complainant.
  5. Your physical or electronic signature.

Send counter-notices to: dmac@zophous.ai — Subject: “DMCA Counter-Notice”.

Upon receipt of a valid counter-notice, we will forward it to the original complainant and restore the removed content within 10–14 business days unless the complainant notifies us that a court action has been filed to restrain the activity.

5. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), Zophous.ai maintains a policy of terminating accounts of users who are determined to be repeat copyright infringers. Determinations are made at our sole discretion based on the totality of circumstances, including the number and nature of valid takedown notices associated with an account.

6. User Responsibility for Uploaded Content

Zophous.ai is a tool that allows users to upload and process video content. Users are solely responsible for ensuring they have all necessary rights to any content they upload, clip, or distribute through our Services. By using our Services, you represent and warrant that your use of any content does not infringe the intellectual property rights of any third party.
